The Cabinet of Nakong (Shangean: 內江內閣; Morwall romanization: noi6 gong1 noi6 gok3), also known as the Government of Nakong (Shangean: 內江政府; Morwall romanization: noi6 gong1 jing3 fu2), is the national cabinet and executive authority of Nakong. Chaired by the Prime Minister, the Cabinet consists of the heads of the departments of state, termed ministers, and any other invitees as designated by the Prime Minister. The Cabinet is responsible to Parliament and must maintain the confidence of the House of Deputies to remain in office.
Members of the Cabinet are appointed by the Prime Minister and serve at his or her pleasure, while the Prime Minister is in turn appointed and dismissed by the Speaker of the House of Deputies in accordance with the chamber's expressed will. The Cabinet is a collegial body which makes decisions by deliberative consensus, and ministers are bound by collective ministerial responsibility to support all decisions made thereafter. Unlike other Northabbey system countries, the Cabinet of Nakong is the fount of executive power, while the President possesses no actual or reserve powers of any kind. As a result, all international agreements and formal government actions are made by the Cabinet in the name of the Government of Nakong, rather than in the name of any individual office or person.
Being vested with the full executive power of the Nakongese state, the Cabinet supervises all functions and departments of the Government of Nakong, and all civil servants are answerable both to the relevant minister and to the Cabinet as a whole. The Cabinet, via the Minister of National Security, is also the commander-in-chief of the Nakong Autonomous Security Force. Unlike Acts of Parliament which are protected by parliamentary sovereignty, decisions of the Cabinet must comport with law and are subject to judicial review by the judicial branch.
Since the 2020 election, the current Cabinet of Nakong has been formed by Prime Minister Andrew Ng Fan-chiu and the Self-Determination Congress. Ng has been Prime Minister since 2012 and the Self-Determination Congress has formed the government of Nakong since the founding of the republic in 1958.
Appointment
Upon appointment by the Speaker of the House of Deputies, the Prime Minister becomes an ex officio member and the chair of the Cabinet of Nakong. By virtue of the latter position, the Prime Minister is empowered by the Constitution of Nakong to issue letters patent appointing any individual of his or her choosing as a member of the Cabinet and tasking him or her with a specific portfolio and mandate.
Ministers hold office at the Prime Minister's pleasure and may be dismissed by the Prime Minister at any time. Such occurrences are common, as the Prime Minister will typically initiate a cabinet reshuffle every few years to renew the membership of the Cabinet. Additionally, all ministers cease to hold office if the Parliament of Nakong withdraws confidence or supply to the government, but may carry on in a caretaker capacity until a new Prime Minister is appointed. Individual ministers may also be removed by Parliament through a vote of no confidence. To date, no successful vote of no confidence has ever passed in Nakong.
Powers
As the head of the executive branch, the Cabinet of Nakong is a powerful body which sets the Government's policy agenda, proposes the majority of bills considered by the Parliament of Nakong, makes secondary legislation in a wide variety of fields, and holds the power to exercise a variety of sovereign prerogatives, such as treaty ratification, the issuance of letters patent and the grant of national awards and appointments to military or civil office. As a collegial institution of peers on equal footing, the Cabinet is required by constitutional convention to make decisions by unanimity, though in practice the Prime Minister is generally able to impose his or her will on the direction of government policy. Individual ministers, by virtue of their leadership of government departments, are able to give directions to the civil service and shape the department's overall policy.
The Cabinet of Nakong is responsible for submitting a yearly budget to Parliament and for drafting a ministerial agenda at the start of each parliamentary term. Powers vested by the Cabinet as a whole or by individual ministers largely derives from Acts of Parliament or the common law, as constitutional convention prohibits ministers from exercising authority which is prohibited by law. As a result, a court may hold in a judicial review that a ministerial action taken without legal authorization is ultra vires, and therefore null and void.
