Abortion is available on request up until twenty weeks since 1991. From 1945 to 1975, abortion was heavily restricted as part of the Little Green Fever, but as a result of Baikun Qing's policies, the Abortion Act of 1945 was repealed, and the Abortion Act of 1975 was implemented, which reinstated the Abortion Act of 1911, but permitted abortions to be made to socio-economic reasons. It has since been superseded by the Abortion Act of 1990 which legalized abortion on request.

The 1940 Abortion Law legalised abortion in Xiaodong, with abortion being permitted in the to protect women's life and fetal defects. In 1959 it was repealed, and abortion was illegal until 1980 when the law was reintroduced and amended to give abortion in the cases of rape (1980) provisions for physical and mental health risks (1998) and incest (2011). Abortions must be approved by a doctor within 2 weeks and must be carried out within 2 weeks of doctors approval, being reduced from 6 weeks in 2011.
