In New California, a county is a subnational political entity, of which there are 58. Each county holds governmental jurisdiction over a separate and defined geographic territory where it shares its sovereignty with the federal government.

County governments in New California are allocated power by the people (of each respective county) through their individual county constitutions. All are grounded in republican principles (this being required by the federal constitution), and each provides for a government, consisting of three branches, each with separate and independent powers: executive, legislative, and judicial. Counties are divided into communes, which may be assigned some local governmental authority but are not sovereign. Although communes vary by county, they are all similar in structure.

Counties possess many powers and rights under the Constitution of New California. Counties and their citizens are represented in the Congress of New California, a bicameral legislature consisting of the Senate and the General Assembly. Additionally, each county has the opportunity to ratify constitutional amendments, and, with the consent of Congress, two or more counties may enter into intercounty compacts with one another. The police power of each county is also recognized.

The Constitution grants to Congress the authority to admit new counties into the nation, yet an example of this is yet to occur. With the approval of the rest of Congress and the consent of the President, counties may secede from the nation, however this is also yet to occur.
