The Emergency Cabinet Act of 2024 (c. 1) is an Act of Council of the 4th Session which was ratified on January 29th, 2024 by Emperor Conall Solis. The act establishes what shall occur if the executive cabinet is missing or dead, and how the government shall operate in that situation. It was tabled as the first act to ratify as a part of the 4th Session after the attempted coup in 2023 near the lapse of the 2nd Session. The act has divided opinions among the public, with some seeing it as a public necessity, and others seeing it as a preparation for something that they expect may see the end of the cabinet that they aren't disclosing to the public.

SECTION I - DEFINITIONS

ARTICLE I - An emergency cabinet shall heretofore be any executive branch at any period of time in the empire where the original branch of operation meets the defined characteristics outlined under this act. For the purposes of this act, the emergency cabinet shall be known as the "emergency cabinet".

SECTION II - INVOCATION REQUIREMENTS

ARTICLE II - This act shall only be invoked by a leading government official, or by a direct subordinate if unavailable.

ARTICLE III - This act shall only be invoked should the executive cabinet entirely, including the Monarch, is determined to be dead, missing or are unreachable by any official with invocation power under Article II.

ARTICLE IV - Should part of the cabinet be missing, dead or unreachable, this legislation shall not be invoked, unless half or more of the cabinet is the part in question, and the Monarch is not in said part.

ARTICLE V - Should Article IV apply, only the highest-ranking executive cabinet member shall invoke this act.

ARTICLE VI - Whoever shall invoke this act shall temporarily receive all the powers and privileges of the Monarch, including immunity, unless the Monarch is not missing, dead or unreachable, subject to restrictions under this act.

SECTION III - IMMEDIATE PROVISIONS

ARTICLE VII - A national emergency shall such be declared immediately when this act is invoked, and shall not be suspended unless the ruling Monarch so consents, or until the Law Council so promulgates.

ARTICLE VIII - Should Article III apply, and it occurred due to an attack, or attacks, on the homeland, martial law shall such be declared when this act is invoked.

ARTICLE IX - The individual who invoked this act through Section II shall immediately with haste form a provisional cabinet and inform the Law Council, if possible, of such declaration.

SECTION IV - EMERGENCY POWERS

ARTICLE X - The emergency cabinet shall have the capability to declare a national emergency, and if necessary, martial law. It shall be required for the Privy Council to approve such a declaration should Article XII be applicable.

ARTICLE XI - The emergency cabinet shall be able to promulgate laws and orders for the purposes of function and for containing the emergency.

ARTICLE XII - The emergency cabinet shall be subordinate to the Privy Council unless the Privy Council shall be declared missing, dead or unreachable.

ARTICLE XIII - The emergency cabinet shall be the leader of the government and of the military, and shall be able to exert control over them respectively.

ARTICLE XIV - Should Article XII be applicable, the Privy Council may such designate additional powers at their discretion.

SECTION V - EXPIRATION OF POWERS & CABINET

ARTICLE XV - The emergency cabinet shall expire immediately upon finding communication with the Monarch, or upon confirmation of their remains. Shall the Monarch be dead, control shall be handed over to the Privy Council until a new Monarch has been crowned.

ARTICLE XVI - The emergency cabinet shall expire immediately upon discovery of the entire executive cabinet, rather alive or dead. Should the entire cabinet be dead, control shall be handed over to the Privy Council until a new Monarch has been crowned.

ARTICLE XVII - An invocation of this act shall expire thirty (30) days starting on the day of invocation. The invocation may only be extended with approval of the Privy Council.

ARTICLE XVIII - Should the Privy Council as a whole be determined missing, dead or unreachable, the provisions under this section shall instead say "highest-ranking military official", excluding Article XVII, which shall not have extension powers be granted to the highest-ranking military official.

ARTICLE XIX - The emergency cabinet shall become permanent if there is no military official capable of exercising Article XVIII, and if the Privy Council is dead, missing or unreachable. This article shall override articles XV, XVI and XVII.

ARTICLE XX - The emergency cabinet shall be held responsible to crown the new Monarch before exercising Article XIX. It shall only be exercised if a new Monarch in the royal line cannot be found.
