The Azillian Penal Code gives the Courts the right to decide whether crimes committed by a certain individual deserve death penalty.

Till before 1940, a Monarch had the privilege to give a "Pardon from Death" to an individual on death row seeking mercy. In 1940, the Parliament led by then Prime Minister Venere Mazhetorih amended the Penal Code, scraping the Pardon Privilege as well as making it harder for those charged with sedition to appeal their death penalty conviction by lower courts. Because of such rules, Aziallis executed more than 3000 individuals between 1940 and 1953.

In 1955, then Prime Minister Bizhvo Svave amended the Penal Code again, though this time around, he empowered a Commission called the Mercy Commission, led by the Chairperson of the Executive Council, to grant mercy. The Commission overruled the death penalty in 93% of the cases brought in front of it, effectively scrapping the death penalty. But Svave was unsuccessful in getting the death penalty removed from the books.

By 1973, 9 States and all Autonomous Entities of Aziallis has abolished the death penalty, and not a single execution had taken place since 1957. Then Prime Minister Charita Sukerni, in 1974, proposed the Bill to remove the death penalty from the Penal Code and finally managed to get approval from the Parliament as well as the Executive Council. Governors of Ajenta and Freyerka opposed the law in the UEC vote, and even sued the Union Government in the Supreme Court, though their writs were rejected by the Court. No bills to reinstate the death penalty have managed to even get out of Parliamentary Committees since then.
